Welcome and thank you for subscribing to Early Bird: The Smart Travel Alarm. Whether you are a Light, Unlimited, or Trial user, all application features are available for your use. Early Bird is designed to ease stress and give back as much time as possible that is generally lost through guessing travel plans.

1. Acceptance of Terms

Your use of the Early Bird application constitutes your agreement to these terms. If you do not agree with these terms, please do not use this application.

2. Description of Service

The Early Bird application provides predictive traffic-based alarm settings to assist you in arriving at your destination on time. The application processes current traffic data and estimates the best departure times. However, the accuracy of the application is subject to limitations and external dependencies as described below.

3. No Guarantee of Accuracy

Early Bird and its developers do not guarantee the accuracy of the timing or traffic conditions reported by the application. The performance of this application is heavily dependent on several factors outside the control of Early Bird and its developers, including but not limited to:

• Availability and accuracy of Internet access

• Sudden changes in traffic conditions

• Technical issues with third-party services such as Google Maps

• The health and functionality of your mobile device

4. Assumption of Risk

By using Early Bird, you acknowledge and agree that there are risks associated with relying on a time-sensitive alarm system based on variable and unpredictable traffic conditions. You assume full responsibility for the risks of not arriving at your destination on time.

5. Limitation of Liability

Early Bird and its developers shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if Early Bird or its developers have been advised of the possibility of such damages), resulting from:

• The use or the inability to use the service.

• Unauthorized access to or alteration of your transmissions or data.

• Statements or conduct of any third party on the service.

• Any other matter relating to the service.

6. Modifications to Service

Early Bird reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. You agree that Early Bird shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the service.

7. General Conditions

Your use of the Early Bird application is at your sole risk. The service is provided on an "as is" and "as available" basis.
